Naughty Santa

IRWIN KRAMER:  He wore a beard.  His car even looked like a sleigh and according to an official Ohio Identification Card, his name was Santa Claus, but when police responded to a minor car accident, and he displayed his Santa Claus ID, Warren Hayes wound up on prosecutors’ bad list.

IRWIN KRAMER:  Prosecutors did not believe in Santa Claus or may be they did not believe that Warren Hayes was Santa Claus.  In any event, they charged him with passing of fictitious ID.

Did they prove their case?

According to the court, there was not anything fictitious about it.  According to the Ohio Bureau of Motor Vehicles, Santa has been a real person since early 1982.  If the Bureau of Motor Vehicles believed in Santa, that was good enough for the court.

JUDGE:  "Since the United States government declares this man to be Santa Claus, this court will not dispute it.  Case dismissed."
